Ringtones and music rights: New America
The market for music, totally in crisis because of Peer2Peer (at least according to some analysts), has found new life in the field of ringtones: by ASCAP, the Association of Composers, Authors, and Producers, musicians are able to obtain already long ago the payment of royalties whenever their ringtone is downloaded.ASCAP did not stop there, however, arriving in the United States to demand a royalty for each performance of the songs, which sounds every time a telephone that was downloaded and put into use a song by a musician belonging to the above category . It is alleged that, in fact, the only sounds that the phone can be compared to a public musical performance.
But a federal judge put a stop to the claims of SIAE overseas: Judge Denise Cote has ruled against the company in fact Authors, by stipulating that
“When an alarm occurs on a phone, even if this happens in public, you are exempt from being subject to copyright fees and even the telephone operator must take responsibility for payment of these sums.”
What would happen if the SIAE in Italy would presume the same conditions?
